30 October pub questions
Plain answers, taken from our 30 October pub notice guide. Not legal advice.
What changes for pubs on 30 October 2026?
From 30 October 2026, employers can be liable for harassment of their staff by customers and other third parties, related to things like sex, race, disability, religion or age, unless they took all reasonable steps to prevent it. Employers must also take all reasonable steps to prevent sexual harassment.
Does the new duty cover harassment by customers?
Yes. From 30 October 2026, employers can be liable for harassment of their staff by customers and other third parties unless they took all reasonable steps to prevent it.
What does taking all reasonable steps look like for a pub?
The duty is about steps. A customer notice is one of the steps a pub can show it has taken, alongside a written policy, a staff briefing and a record of what happens. A notice near the bar tells customers how staff should be treated. On its own it is not the whole answer. It works best as part of a short set of papers that put in writing the steps you've taken: policy, staff briefing, customer notice and a record sheet.
What can happen if a sexual harassment claim is upheld?
If a tribunal upholds a sexual harassment claim and finds the duty was breached, it can increase compensation by up to 25%.
Who can take enforcement action?
The Equality and Human Rights Commission can take enforcement action against employers who do not take all reasonable steps to prevent sexual harassment.
Is reporting sexual harassment protected?
Since 6 April 2026, reporting sexual harassment can count as a protected whistleblowing disclosure (Employment Rights Act 2025 s23).
