30 October care questions

Plain answers, taken from our 30 October care notice guide. Not legal advice.

What changes for a care home on 30 October 2026?

From 30 October 2026, employers can be liable for harassment of their staff by customers and other third parties, related to things like sex, race, disability, religion or age, unless they took all reasonable steps to prevent it. Employers must also take all reasonable steps to prevent sexual harassment.

Does it cover harassment by residents' visitors and families?

Yes. From 30 October 2026, employers can be liable for harassment of their staff by customers and other third parties unless they took all reasonable steps to prevent it.

What does taking all reasonable steps look like for a care home?

The duty is about steps. A notice for residents' visitors and families is one of the steps you can show you have taken, alongside a staff briefing and a record of what happens. For example: A resident's son repeatedly makes sexual remarks to a care worker when he visits. The worker tells the senior on shift. The manager speaks to him, agrees visiting arrangements that keep the worker away from him, and records it. Repeat behaviour can lead to changes to how visits happen, in line with the home's visiting policy.

What can happen if a sexual harassment claim is upheld?

If a tribunal upholds a sexual harassment claim and finds the duty was breached, it can increase compensation by up to 25%.

Who can take enforcement action?

The Equality and Human Rights Commission can take enforcement action against employers who do not take all reasonable steps to prevent sexual harassment.

Is reporting sexual harassment protected?

Since 6 April 2026, reporting sexual harassment can count as a protected whistleblowing disclosure (Employment Rights Act 2025 s23).
